Dyncorp International, a defense contractor that provides security teams for the US Government in overseas missions along with other hands on services, is being sued by two former employees who were called up by the National Guard to serve in Afghanistan. Upon completion of the tour, the two men allege that Dyncorp refused to give them back their jobs as required by the Uniformed Services Employment and Re-employment Rights Act (USERRA). Wayne Mendenhall and Jay Middleton both worked for Dyncorp as security specialists prior to activation by the National Guard in 2005. They served a one year deployment in Afghanistan, and upon their return claim that Dyncorp refused to reinstate them in their former positions.

Representing Mendenhall and Middleton are Michael Barnsback of the Virgina firm DiMuroGinsberg and lawyers from Foulston Siefkin in Kansas.
